§ 303.36. Prerequisites for issuance of approval and requirements in the event of later discovered conditions.
In the event that the health department inspection reveals the presence of any of the following conditions, the following action shall be taken prior to the issuance of a demolition approval. In the event that any of the following conditions are not found in the course of the health department inspection, but are later discovered during the course of demolition, the discovery shall be reported to the health department and all demolition work shall immediately cease until the following action has been taken and verified by the health department:
(1)
If vermin are found to be present on the premises, the applicant is required to have the premises treated by a licensed exterminator.
(2)
If septic tanks are found to be present, they shall be properly abandoned by a licensed septic tank contractor in accordance with the provisions of Chapter 64E-6, Florida Administrative Code, unless the applicant demonstrates to the health department that the septic tank is in good condition and demonstrates that it is the applicant's intention to connect the septic tank to a structure within the next six months.
(3)
If underground storage tanks are found to be present, they shall be properly removed and disposed of or abandoned in place, in accordance with the provisions of applicable law. In the absence of other applicable law, the tanks shall be environmentally stabilized in place.
(4)
If asbestos is discovered or if the health department has reason to believe that asbestos may be present, the applicant shall retain the services of a licensed asbestos surveyor to inspect the premises, and, if required, a licensed asbestos contractor to remove any asbestos in accordance with applicable law.
(5)
If potable or irrigation wells are found, they shall be abandoned in accordance with applicable law, unless the applicant demonstrates to the health department that the well is in good condition, in which case it may be capped in accordance with the provisions of the Florida Administrative Code.
(6)
All other materials listed in section 303.34 above shall be removed and disposed of in accordance with applicable law.
